Summary of the Candidates Postions on Immigration

USA Today ran a story recently titled: Immigration at Front of 2016 Presidential Race.

The article summarized the positions on Immigration of the current and likely Presidential candidates.  It is a must read for anyone who is interested in how the future of Immigration law is likely to shape up depending on who wins the white house in 2016. Their stances are varied.

Hillary Clinton, the front runner in the Democratic party supports a pathway to citizenship that would likely go even further than the stance of President Obama.

 

“Wisconsin Gov. Scott Walker, for example, has abandoned his past support for comprehensive immigration reform and moved to the right, denouncing “amnesty” and discussing the need to possibly limit legal immigration to protect U.S. workers.

Sen. Marco Rubio of Florida was one of the four Republican negotiators who authored a bipartisan immigration-reform bill that passed the Senate in 2013, but he since has distanced himself from the legislation, which included a pathway to citizenship.

Sen. Ted Cruz, R-Texas, describes himself as a supporter of legal immigration, but he opposes a pathway to citizenship and “amnesty.”

Likewise, Sen. Rand Paul, R-Ky., at times has signaled an openness toward immigration reform, but he voted against the 2013 Senate bill and like other Republicans opposes Obama’s executive action and “amnesty” and wants border security first””.

It is clear that Immigration will be a key early issue in the fight to see who will be our next President.

According to the article: “observers are pessimistic about the chances for passage of immigration-reform legislation even in the early administration of the next president, given that at least the House is expected to remain under Republican control after the 2016 election. But the Republican primary maneuvering on immigration could again complicate the party’s chances to win the White House in the general election.”

“Latino voters are going to be a critical factor in at least five swing states: Colorado, Nevada, New Mexico, Florida and Virginia,” Sharry of America’s Voice said. “Obviously, Jeb Bush is trying to maintain a center-right position on immigration reform in order to remain competitive in the general election. The question is will Republican primary voters reward him or punish him?”

It will be interesting to see how the candidates do in the primaries.  It is clear that how they view Immigration will be critical with the voters.

Can I Make My Fiance Visa Case Go Faster?

I speak to potential clients every day about the fiancé visa process.  The one question I am always asked is how long does the fiancé visa process take to complete?  The other question I am asked is if there is any way to make the fiancé visa process go any faster.  Some clients also want to know if they may pay an extra fee to USCIS in order to make their fiancé visa case go faster.

Currently the fiancé visa process from the time of the first filing to the time your fiancé enters the United States is 6-9 months.  This amount of time can change.  It is based primarily on the number of visas your consulate or embassy is dealing with.  If there are a lot of visas being processed by your consulate or embassy the wait will be longer.  If there are not a lot of visas the wait will be shorter.  It is even possible for the entire process to take less than 6 months. It is not likely but it does happen.

Once in a while a potential client will state that another law office has stated that they can get USCIS approval in a shorter time period than the 6-9 months I quote.  I tell the potential client that this is true USCIS will approve the case faster than 6-9 months.  However, just because a case is approved by USCIS does not mean that the fiancé will be able to enter the U.S.  The case will still need to go to the National Visa Canter and then be processed by the embassy or consulate having jurisdiction over the case.  The 6-9 month number is the time period from when the case is filed to when your fiancé will be with you in the United States.  This, I am sure, is the more relevant time period to the potential client.

There is no way to expedite the process.  Unlike some other visa categories you cannot pay extra in order to have your fiancé visa processed faster.  So called “premium” processing does not exist in the fiancé visa arena.  Be wary of anyone who says that this can be done as it cannot.

If you file a fiancé visa be prepared to wait 6-9 months for your fiancé to enter the United States.  If you are considering filing a fiancé visa you should also consult with an Immigration Attorney about marrying your fiancé instead and doing the green card process.  There are benefits and draw backs to both routes. You should compare both routes, in detail, to see which one makes more sense for you.

Under U.S. law, unless the family member is an “immediate relative”, there are annual limits on the number of foreign family members who can obtain their green card. (Immigrant visas to “immediate relatives” are unlimited and are always available.  You do not need to use the visa bulletin to check on wait times if your relative is an “immediate relative”. An Immediate relative is a Spouse of a U.S. Citizen; an unmarried child under 21 of a U.S. Citizen; or a parent of a U.S. Citizen if the U.S. Citizen is over 21.)

Because demand for green cards is greater than the supply of available green cards there is a backlog of petitions and a waiting list for a visa.  Your relatives place in this line is based on his category (preference category) and  priority date. When your relative’s priority date is current he can apply for his visa to come to the United States.  You can find this priority date at the top of your I-130 approval notice.

The visa bulletin is issued every month.  This guide will inform us if a visa is immediately available for your family member.

Simply look and see in which sub-category your family member belongs.  You can then see that the expected wait time will be for your family member to obtain their visa.  If the sub-category says “C” that is very good news.  It means that a visa is immediately available for your family member.

Jeb Bush’s Stance on Immigration

Jeb Bush has not announced whether or not he is running for President.  If he does run, according to the Business Insider, he would be the favorite to win the Republican nomination.  Obviously his views on Immigration are very important.

According to a recent exclusive interview with Fox News   Mr. Bush would back legal status but not citizenship for those who have entered the country illegally.

“In response to criticism by conservatives that he supports a form of amnesty for illegal immigrants, Bush said he backs legal status — but not citizenship — for those who have entered the country illegally.

“A practical solution of getting to fixing the legal system is also allowing for a path to legalized status, not necessarily citizenship,” he said.

Nevertheless, he suggested that the country must take some kind of common sense approach to what to do with an estimated 11 million people living illegally in the United States, particularly children of illegal immigrants.

“What are we supposed to do, marginalize these people forever?” Bush asked.

He also suggested he would undo President Obama’s executive actions that suspend deportation for some illegal immigrants, under comprehensive reform legislation.”

This suggests that Mr. Bush would take some action on Immigration as President.  He would not be as pro Immigrant as President Obama. Nor would he be as pro Immigrant as Hilary Clinton.  Ms. Clinton’s stance apparently will be even more pro immigrant than that of President Obama.

As Immigration reform is a huge issue in the United States it is apparent that we will hear more from the candidates (and potential candidates) about Immigration reform in the months to come.

How to Obtain a Green Card For a Parent

How to Obtain a Green Card For a Parent

This article is an overview of how a U.S. citizen can obtain a green cards for his or her parents.

First, in order to obtain a green card for your parents you must be a U.S. Citizen who is at least 21 years old. (Remember, as a U.S. Citizen, while you can help your parents, spouse or children to immigrate to the United States quickly it is much harder to get green cards for your brothers or sisters. You are not able to bring over other relatives such as grand parents and aunts and uncles. These relatives would have to be petitioned by other relatives.)
There are other important things to consider – you must show that you have enough income or assets to support your parents during their stay in the US at a level that is 125% of the US poverty rate – apart from supporting your own family. The reason for this is to ensure that the government is not obliged to provide for your parents once they immigrate to the USA.
Also, it is important to note that your parents can be denied permission to immigrate to the United States and not be given green cards if, among other things, they have criminal convictions in the past in their home countries or elsewhere, have violated immigration norms or carry a disease which is a definite health risk to the public. Also, if they have physical or psychological issues that are dangerous to the public, they will be denied green cards. You should speak to an Immigration Attorney if you have questions in this area.
Typically your parents won’t have to wait long to get green cards since they are immediate relatives.  Wait times change and can vary.   Feel free to contact us about current wait times.
The process for obtaining a green card for your parents is as follows:
First, you will need to fill out a form called the I-130, which is called Petition for Alien Relative. This is issued by the United States Citizenship and Immigration Service (USCIS). The purpose of this petition is to prove the parent-child relationship that exists between yourself and your parent, as well as your status as a bona fide US citizen.
So, you will be asked for a copy of your naturalization certificate, US passport, and any other proof of citizenship. You will have to submit your birth certificate, documents that prove your parents’ identities and their relationship to you. Remember – always send the copies of these documents, and never the originals, because you won’t get them back. If you want green cards for both, your father and mother, then you should apply for two separate I-130 petitions.
Once the visa petition is approved by the USCIS you will receive an approval notice (this does not mean that the overall case has been approved but only that the USCIS portion of the case has been approved. Your case will be  forwarded by USCIS to the National Visa Center (NVC). Once the NVC is done processing it they will send it to the US consulate in your parents’ country for their visa interview. If the interview goes to plan and no discrepancies are found, their immigrant visa will be approved and they will be given the permission to enter the United States and get their Green Cards so that they can become lawful permanent residents

Hillary Clinton Shares Her Stance on Immigration

Yahoo Finance had an interesting story yesterday about Hillary Clinton and her stance on Immigration.  The article was titled: Hillary Clinton Takes Aggressive Stance on Immigration.

Clinton’s stance on Immigration is very important as according to the International Business Times she is the most likely candidate to win the 2016 election.   (“Hillary Clinton – – the former first lady, U.S. senator and secretary of state – – is currently the clear favorite to win the presidency in 2016 with 5/4 odds”.)  As President she will have a very powerful role in shaping the future of our nations’s immigration policy.

According to the Yahoo Finance article: “Clinton said she backs nothing less than a “full and equal” path to citizenship for undocumented immigrants.” She believes that “legal status” (as spoken about by Republican Presidential hopefuls) for undocumented immigrants is not enough. She called legal status “…code for second class status.”

It appears that if she becomes President her stance on Immigration would be even more aggressive than that of the stance by current President Barack Obama.  According to the article, “Clinton vowed to protect President Barack Obama’s executive actions and to go even further if Congress were to block broader immigration legislation. “I would do everything possible under the law to go even further”, she said.”

Clinton also stated that she supports a way for parents of DREAMers and others “to be eligible for the same deferred action as their children”. This is beyond what the Obama administration has been willing to do. “That’s something that the Obama Justice Department said last year “would not be a permissible exercise of enforcement discretion, ” but Clinton press secretary Brian Fallon said on Twitter that the candidate would do so by “creating a clear process for additional sympathetic cases, like parents of DREAMers, to have the chance to be heard.””

Whether or not Clinton would be able to extend deferred action to parents and others will remain to be seen.  However, it is apparent that Clinton would like to be even more pro immigrant than President Obama.

It is clear that Clinton will be aggressive in the area of Immigration.  Perhaps under a Hillary Clinton presidency we will finally get comprehensive immigration reform.
