I would like my sister to apply for a green card instead of having to use tourist visas all the time.
I am a United States Citizen. I would like my 55 year old sister to apply for a green card so that she will be able to come into the United States whenever she wants without the hassles of waiting in long lines. I would like her to be able to apply for a green card so that she come and go back and forth from her country and the United States. My sister does not intend to live in the United States. Is obtaining a green card a good idea for her?
A green card is not meant to work as a “better” tourist visa which can be used to enter the United States more easily. A common misconception about green cards is that they can be used to allow you unlimited travel in and out of the United States without the hassle of reapplying for visas. This is simply not true.
If your sister plans to have her primary home outside of the United States then it is likely that USCIS will figure this out and cancel your sister’s green card. (Basically if a holder of a green card leaves the United States with the intention of making another country her home then she will lose the green card.) This is because USCIS can deem that her green card has been abandoned. USCIS officials will be looking for signs that indicate that her true residence is outside the United States. If this is determined then your sister would have to start the process over by having to again apply for a green card. This would cost time and money.
At this point, your sister would be better served by simply obtaining tourist visas when she visited the United States. Only when she is really ready to make the United States her home should she ask you to sponsor her for a green card.
It appears, from many different sources, that there will be reforms in immigration law over the next several months (there has already been some reforms which may apply to you). These laws will affect anyone who lives in the U.S. illegally or has loved ones who live in the U.S. illegally.
