What is a K1 Fiancé Visa?


A K-1 visa is meant for U.S. citizens who want to bring their fiance to the United States so that they can marry. The fiancé or fiancée and U.S. citizen are required to marry within 90 days of the entry to the USA on a K-1 visa. Once the couple is legally married they can file an application for the K-1 to become a lawful permanent resident.
Form I-129F, Petition for Alien Fiance(e) starts the application process. If a foreigner does not marry the U.S. citizen within 90 days, then he or she will not be able to adjust their status in the United States barring unusual circumstances.
The U.S. Citizen and their fiancé both have the intent to marry within 90 days of the fiance’s entry to the United States.
If either party were married previously, those marriages have legally ended in divorce, death or annulment
The parties have met with one another at least once within two years of filing the petition for the visa. There are only two exceptions to this requirement which are that it violates a social custom or religious practice, or you prove that the requirement is an extreme hardship on you.

K-1 visa holders may apply for a social security number with the Social Security Administration after entering the U.S. This person must show a valid and unexpired I-94.
Once the K-1 visa holder arrives in the United States, it is advisable that the parties marry as soon as possible and file the application for lawful permanent residence as quickly as feasible
