The New York Times ran an article by Julia Preston on February 11, 2012 titled “Rules Revised for H-2b Guest Worker Program”. (The H-2B non-agricultural temporary worker program allows U.S. employers to bring foreign nationals to the United States to fill temporary nonagricultural jobs.)
“The H-2b program has long been used by any kinds of seasonal, mostly small, businesses, including seafood fishermen and processors amusement parks and hotels and landscapers”.
The new rules which will take effect on April 23,2012, would “strengthen protection for those (foreign) workers and also spur recruitment of Americans for such jobs.
There were 575 pages worth of rules. “The changes were hailed by advocates for guest workers, who said they would make it more difficult for businesses to exploit vulnerable foreign migrants and hire them to undercut Americans”.
The article goes on to explain how the new rules will affect employers, foreign workers and american workers.
An example of how the new rules will help protect foreign workers is found in the next to last paragraph of the article. “The new rules bar foreign recruiters from charging fees to workers who will come to the United States under the H-2B program. The Labor Department is seeking to eliminate foreign recruiters who saddle migrants with debts before they arrive in the United States, which workers struggle to pay on their wages here.”
It appears that these new rules will help both American and foreign workers.
