Q. I am a United States Citizen and I am filed a petition for my brother who is 30 years old. He is single and is a Mexican citizen living in Guerrero. It has been a few years since I applied for him. How do I check to determine when he will get his green card?
Your brother is in the family fourth category. Currently the wait for a green card for a person in this category from Mexico is about 20 years. However, this time period is not “set in stone” and it can change over time. You are wise to check regularly to see if your brother is eligible for his green card. There are two steps to this process. First, you have to have an approved petition filed for your brother. While the petition is pending you can check the status of your immigration petition online or in person. If you want to check your status online visit the USCIS website at uscis.gov. Once there click the “Check My Case Status” link and enter your receipt number.
After you enter your receipt number, circles will appear on your screen. The circle which is highlighted will indicate the immigration status of the case you are researching.
You can also always make an appointment to speak to an Immigration officer by visiting the same USCIS website and making an appointment using INFOPASS. Obviously, as a United States citizen you can use the INFOPASS process (please do not make this appointment with USCIS if you are here illegally or out of status).
Once the petition is approved you have to wait for a visa to become available for your brother. You should regularly check the visa bulletin that comes out every month. It is also critical to make sure that the National Visa Center has your current address.
