 I am a Lawful Permanent Resident and I would like to apply for a K-1 Fiancee Visa for my Fiancee in the Phillipines.  Can I apply now?

No, unfortunately you will not be able to successfully apply for the K-1 fiance visa at this time. You cannot apply for a K-1 fiancee visa if you are only a lawful permanent resident (aka green card holder).  Only a United States citizen may successfully apply for a K-1 fiance visa.

Lawful Permanent Residents may file for a marriage visa only (again green card holders are not able to successfully file for a K-1 fiance visa). However, if you are a permanent resident and you are applying for a marriage visa then you should realize that this process generally takes several years.

If  you are a lawful permanent resident  and you are eligible to apply  U.S. citizenship (please see our blog post: “10 Things USCIS Checks at Your Citizenship Interview” ) then you may wish to apply for your U.S. Citizenship and then apply for the fiance visa. A lawful permanent resident, even if he or she is in the process of applying for US Citizenship, cannot file for a K-1 fiance visa until he or she actually becomes a US Citizen.  If you file your K-1 fiance visa prematurely then the K-1 fiance visa will not be approved.  You will then need to start the process over from the beginning  once you become a naturalized U.S. Citizen. In addition, your the filing fee you have paid to USCIS will be forfeited.
