Q. My wife is in the United States and I want to apply for her to get her green card based on marriage to a U.S. Citizen. How long is the process taking in the Sacramento area?
Currently, the interview should be held within about 4 months from the time you file your case with USCIS in Chicago. If all goes well, barring any security check issues or other issues, then she should expect to receive her green card, in the mail, about 2 to 4 weeks after the interview.
However, before you apply to adjust the status of your wife you should definitely meet with an experienced immigration attorney. He or she can review your wife’s immigration and criminal history and make sure she qualifies before you file for adjustment of status. This area of the law has many pitfalls and I would not suggest cutting corners or working with a paralegal or notario. The consequences of failure in your case can be quite severe (e.g.”in some cases your wife can be put into removal proceedings, (meaning she can be deported) for 10 years). Therefore, it makes sense, given the potential for serious issues to arise, to at least consult with an experienced immigration attorney before you file this type of case.
