I am often asked about the K1 visa process , the K1 visa form and the procedure needed to bring a fiancé to the United States.
If you are a foreign person and fiancé of a U.S. citizen you must obtain a K1 visa using the K1 visa form in order to marry that person in the United States and become a permanent resident. In order to obtain a K1 visa, the necessary forms must be filled out. My office can prepare these forms for you. Of course, both the U.S. citizen and the foreigner applying for the K1 visa must be free to marry each other.
The K1 visa form needed to obtain a K1 visa include the I-129F, the Petition for Alien Fiance(e) and the G-325a form prepared by the fiancé. These forms must be filled out by the U.S. citizen with the appropriate USCIS office. Once the petition is approved, it is sent to the National Visa Center which forwards the application for further processing to the U.S.embassy or consulate where the foreigner will apply for the K1 nonimmigrant visa.
Form I-129F and G-325a can be downloaded on the USCIS website. They also have PDFs that include instructions on how to fill out the form. This form needs to be filled out in order to bring the foreigner and their children (if they have them) to the U.S. for marriage. The form includes three pages and seven pages of instructions. Make sure to also download form G-1145, Notification of Acceptance of Application/Petition and attach it to the first page of your application package.
The filing fee for the I-129F is $340. Of note: there is no fee for petitions on K2 status (bringing foreigner’s children to the U.S.). U.S. citizens filling out the form for K2 visas must include form I-797C in addition to form I-129F.
